Preamble

DIGITAL PROD is a company dedicated to the creation and production of premium digital content.

In line with its values, DIGITAL PROD also attaches great importance to respecting the protection of personal data and respect for privacy.

This Personal Data Protection Policy (hereinafter “the Policy”) describes the conditions under which DIGITAL PROD collects and processes the data of its Customers and partners as well as the Data collected on the Site accessible at the address following url: https://www.digitalprod.com/fr (hereinafter “the Site”).

The Site aims to present the activities, projects and philosophy of DIGITAL PROD, as a creative agency. In addition to these features, the Site allows users to learn more about the Creative Agency and to contact it.

Article 1. Definitions

For the interpretation and execution of this Policy, the terms used below are defined as follows:

“Processing Manager” : Refers to the person, service or organization which determines the purposes and means of the processing of Personal Data;

“Subcontractor” : Refers to the natural or legal person who processes personal data on behalf of the Data Controller;

“Processing” : Refers to any operation on Personal Data, and in particular recording, collection, organization, conservation, adaptation or modification, extraction, consultation, use, communication by transmission, distribution or any other form of making available, reconciliation or interconnection, as well as blocking, erasure or destruction;

“DIGITAL PROD” or “Creative Agency” : Refers to the simplified joint stock company, with share capital of 50,000 euros, registered with the Paris Trade and Companies Register, under number B 511 233 595 and whose head office is located 76 Rue du Faubourg Saint-Denis, 75010 Paris, France;

“Site” : Refers to the website accessible at the following URL address: https://www.digitalprod.com/fr ;

“Concerned person” : Any natural person whose data is processed by DIGITAL PROD in the context of its activities;

“Personal data breach” : Means a breach which results, accidentally or unlawfully, in the destruction, loss, alteration, unauthorized disclosure of personal data transmitted, stored or otherwise processed or unauthorized access to such data.

Article 2. Source of Data

When browsing the Site, the following data may be collected:

  • Identification data of the Person concerned such as their first and last name using the contact form on the Site;
  • Contact data in particular through any contact and Newsletter subscription forms present on the Site (email address, telephone number, etc.);

  • When necessary for the execution of a contract or in the context of commercial relations;
  • When the legitimate interests of DIGITAL PROD justify the processing of the Data of the person concerned.

The absence of communication of the Data required in the collection form present on the Site or in the contracts concluded, as well as the subsequent withdrawal of the consent of the Data Subjects, will prevent DIGITAL PROD from responding to their request or concluding the contract.

Article 4. Use of data and purposes of processing

The personal data collected from the Data Subject and processed by DIGITAL PROD are for specific, explicit and legitimate purposes and are likely to vary depending on the context of the collection, namely for the following purposes: Provision of content and services on the Site (Cookies);

  • Management of any possible requests sent via the Site;
  • Management of any possible application requests via the Site;
  • Management of newsletter subscriptions;
  • Order management ;
  • Execution of rights transfer contracts;
  • Management of contractual relationships with customers;

Article 5. Data retention period

DIGITAL PROD only retains Personal Data for the duration necessary to achieve the purpose for which the collection was carried out.

The retention period may vary depending on specific circumstances such as regulations, the latter of which may in particular impose a specific duration or limitation periods concerning legal disputes.

DIGITAL PROD, as Data Controller, undertakes to respect the retention periods imposed by the regulations in force which break down as follows:

In the case of processing for which DIGITAL PROD intervenes as a subcontractor, the Data is processed according to the personal data protection policies of third-party companies, clients of DIGITAL PROD.

Article 6. Data recipients

The information collected and processed through the Site and contracts concluded with DIGITAL PROD may be communicated to the following recipients:

  • To DIGITAL PROD personnel authorized to process Data;
  • To DIGITAL PROD Subcontractors (in particular the Site host and accountants).

  • To administrative and judicial authorities to meet legal and regulatory obligations.

These third parties with whom your data may be shared are limited (by law and by contract) in their ability to use your Personal Data for the purposes specifically identified by DIGITAL PROD.

Article 8. Rights of Data Subjects

In accordance with the regulations in force, Data Subjects have a right of opposition and a right to limit the processing of Personal Data concerning them, as well as a right of access, rectification, portability and erasure of Personal Data.

When processing is based on consent, the Data Subject may withdraw consent at any time.

The Data Subject may exercise their rights by sending, if necessary, their request accompanied by their first and last name and contact details previously communicated to DIGITAL PROD to the following email address: contact@digitalprod.com or by post to 24 Rue de L 'Est 75020 PARIS.

DIGITAL PROD undertakes to respond to any request as quickly as possible, and in any event within one (1) month from receipt of the complete request. If necessary, the request must include a copy of the applicant's identity document (front/back). This deadline may nevertheless be extended by two (2) months taking into account the complexity and number of requests.

  • Right of information
    DIGITAL PROD undertakes to inform the Data Subject of the collection and use of Personal Data and thus undertakes to produce concise, transparent and accessible information on the conditions and modalities of the collection and processing of Personal Data.
  • Right of access
    The Data Subject has a right of access to obtain information on the existence of Processing and its terms. The Data Subject may also obtain a copy of the Data by making a request to DIGITAL PROD.

DIGITAL PROD will be the sole decision-maker on the merits of these requests. In addition, DIGITAL PROD may, where applicable, oppose a legitimate interest or compelling reasons to the request when the applicable legislation so provides.
  • Right to limitation of processing
    The Data Subject may obtain from DIGITAL PROD the limitation of the processing carried out when one of the situations listed below occurs:
    ➢ When the accuracy of the Personal Data is contested, and for a period allowing DIGITAL PROD to verify the accuracy of the Personal Data;
    ➢ When the processing is unlawful and the Data Subject objects to the erasure of their Personal Data and demands, instead, the limitation of the processing;
    ➢ When the Data is no longer necessary for the purposes for which it was collected but the Data Subject needs it for the establishment, exercise or defense of legal rights;
    ➢ When the Data Subject objects to the processing which would be based on the legitimate interest of DIGITAL PROD during the verification of whether the legitimate grounds pursued by DIGITAL PROD prevail over those of the Data Subject.
  • Right to portability
    The Data Subject may obtain from DIGITAL PROD Data previously provided to the latter in a structured, commonly used and machine-readable format. The Data Subject may also transmit this Personal Data to another data controller or request that the Personal Data concerning him or her be directly transmitted by DIGITAL PROD to another company if this is technically possible.
  • Right to withdraw consent
    The Data Subject may, using the means implemented by DIGITAL PROD for this purpose, withdraw their consent at any time when the Personal Data concerning them are processed on the basis of it. The withdrawal of consent carried out by the Data Subject only applies for the future, and cannot therefore call into question the lawfulness of the processing carried out before this withdrawal.

Article 9. Data Security

DIGITAL PROD ensures that data is processed in complete security and confidentiality, including when certain operations are carried out by Subcontractors.

To this end, DIGITAL PROD implements appropriate technical and organizational measures to avoid the loss, misuse, alteration and deletion of Personal Data.

These measures are adapted according to the level of sensitivity of the Data processed and the level of risk presented by the Processing or its implementation.

If a data security breach occurs, DIGITAL PROD will inform the Person concerned within the time frame and in the manner specified by the legal and regulatory provisions in force.

Article 10. Third party sites and hypertext links

The Site may contain links to other websites operated by third parties.

This Confidentiality Policy only applies to Personal Data collected and/or processed by DIGITAL PROD.

Thus, DIGITAL PROD is in no way responsible for the Personal Data that third parties may collect, save and use on their own websites.

DIGITAL PROD therefore recommends that each Data Subject carefully read the privacy policy of each website they consult.

Furthermore, DIGITAL PROD is not responsible for hypertext links leading to the Site and which third-party websites could integrate.

Article 11. Modification of this Confidentiality Policy

DIGITAL PROD has the possibility of modifying this Confidentiality Policy, in particular but not exclusively in the event of changes in the regulations regarding the processing of Personal Data.

In the event of a slight modification of this Policy, DIGITAL PROD will inform the Person concerned by inserting a text message on the home page of the Site.

In the event that the modifications made are substantial, the Person concerned will receive an email to inform them and to obtain their informed consent.
